This Legal Notice regulates the access, browsing, and use of the website housevisionai.com and all of its subpages and subdomains (hereinafter, "the Website" or "the Portal"), as well as the SaaS platform and its associated tools (hereinafter, "the Services").

IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

1. Identification Data and Ownership

In compliance with the duty of information set out in Article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI-CE), the legal identification data of the service provider is provided below:

2. Conditions of Access and Use of the Portal

Accessing and/or using this Portal attributes the condition of USER to you, which implies full and unreserved acceptance of each and every provision included in this Legal Notice from the moment you access the Portal.

2.1. Obligation of Proper Use of the Services

The User agrees to use the Website, its contents, and Services in accordance with applicable laws, moral standards, good customs, public order, and the provisions of this Legal Notice. It is strictly prohibited to use the Portal for purposes that damage the assets or interests of the Provider or third parties, or in any other way overload, damage, or disable networks, servers, computer equipment (hardware), or software programs of the Provider or third parties.

2.2. Age Restriction

The Services are intended exclusively for users who are at least eighteen (18) years old. Persons under the age of 18 are not permitted to register or use the platform. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this contract.

3. Acceptable Use and Prohibited Activities

By using the Services, you agree to comply with the following conditions:

  1. Data Scraping: You are prohibited from systematically retrieving data, images, text, or market valuations from the Portal to create a database, directory, or to train, develop, or improve any machine learning or artificial intelligence models without our prior written consent.
  2. Reverse Engineering: You agree not to decipher, decompile, disassemble, or reverse engineer any of the algorithms or source code comprising the HouseVision AI platform.
  3. Prohibited Content and Images of People: The Service is strictly intended for real estate visualization. You are prohibited from uploading images containing identifiable individuals. All uploaded images must primarily depict physical rooms, properties, or landscapes.
  4. Copyright: You must own the copyright or have the necessary commercial license to upload and modify any images on the platform. The Provider assumes no liability for copyright infringement claims from third parties regarding user-uploaded assets.
  5. Deceptive AI Use & Deepfakes: You agree not to use the Service to generate misleading, deceptive, fraudulent, or non-consensual content, or to impersonate any real person. The Provider will immediately report any attempts to generate Child Sexual Abuse Material (CSAM) to relevant law enforcement and the NCMEC.

4. Intellectual and Industrial Property

4.1. Platform Ownership

All intellectual property rights of the Website, its graphic design, source code, AI orchestration algorithms, databases, logos, trademarks, and interfaces are owned exclusively by the Provider or its authorized licensors, protected by Spanish and international copyright laws.

4.2. Ownership of Generated Content

Subject to your strict compliance with these Terms and the payment of corresponding subscription fees:

  • The User retains full ownership of their original uploaded images.
  • The User owns the final decorated renders, texts, and videos generated by HouseVision AI's engine, holding full commercial rights to use them.
  • The User grants the Provider a non-exclusive, worldwide, transferable, royalty-free, and temporary license to host, process, and display the uploaded and generated assets solely to provide, maintain, and optimize the contracted Services.

5. Exclusion of Warranties and AI Disclaimer

The Artificial Intelligence technology used by this platform is inherently probabilistic and rapidly evolving. The Provider shall assume no liability for commercial decisions made based on outputs generated by the Portal.

5.1. Virtual Staging Disclaimer

AI-powered virtual furnishing, wall painting, floor changing, and sky replacement are digital simulations intended solely for real estate marketing and inspirational purposes. They do not constitute an architectural plan, a structural engineering study, a real-world physical renovation, or a guarantee that the physical property can be decorated identically in reality. The User is solely responsible for verifying the real physical condition of the property before making any commercial transactions.

5.2. Automated Valuation Model (AVM) Disclaimer

Our AVM valuation tools estimate a dynamic market price by combining Big Data algorithms, public land registries, and predictive models. This report does not constitute a certified, official, or licensed bank appraisal, nor does it represent professional financial or investment advice. Actual real estate market prices depend on complex physical supply and demand dynamics. The Provider disclaims any liability for economic losses arising from pricing strategies based on these automated estimates.

6. Data Protection (GDPR & CCPA)

The Provider complies with the provisions of Regulation (EU) 2016/679 (GDPR), Spanish Organic Law 3/2018 (LOPDGDD), and applicable international privacy laws (including California's CCPA).

7. Sole Proprietorship Liability

The User acknowledges and agrees that the platform is operated by a sole proprietor (autónomo under Spanish Law). To the maximum extent permitted by applicable law, any professional civil liability arising from the provision of the Services is strictly limited to the total amount paid by the User to the Provider during the twelve (12) months immediately preceding the event giving rise to the claim, or to an absolute limit of one hundred euros (€100) if the User is on a free plan.

8. Modifications to these Terms

The Provider reserves the right to modify, suspend, update, or cancel any part of these terms at any time without prior notice to adapt to legal updates or market requirements. Users are advised to review this document regularly. Your continued use of the Services after changes are posted constitutes your binding acceptance of the updated terms.

9. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain. For the resolution of any dispute or lawsuit arising out of or in connection with the Website or these Services, and provided that the law permits express submission, both parties agree to submit to the exclusive jurisdiction of the state courts located in Alicante, Spain, waiving any other jurisdiction that may correspond to them.
